The weighted value of the ballots resulted in a vote of 42.9% in favor and 57.1% opposed. The adjacent Sunset district undergrounding project also was rejected, 48.7% to 51.3%. |

February 22, 2010: Vote Scheduled.
| The Del Mar City Council has set April 26, 2010 for its hearing on the assessment levy for the North Hills Undergrounding District, with ballots to be tabulated the next day. |
| Ballots will be sent from City Hall to record owners of property in the proposed district by US Mail. Between the dates of the ballot mailing and the hearing, the City will host an informational meeting to answer voters' questions about the ballot. The date of that meeting will be included in your ballot information. |
| Volunteers for the project are now directing our efforts to issues including financial aid, poles in Crest Canyon, and vetting contractors for undergrounding of individual service lines. A fund has been established to help those who may need financial assistance, and the raising of additional funds
and pledges is underway. |

February 12, 2010: City Council Action.
| At its meeting on February 2nd, the City Council adopted resolutions establishing the boundaries of the North Hills Undergrounding District and accepting the assessment engineer's report. |
| This decision made it possible for the vote to go forward. The Council instructed City staff to mail the ballots at least 45 days before a public hearing for counting the ballots, and tentatively set the hearing for April. |

January 20, 2010: Assessment questions.
| Since sending out the draft assessments, several homeowners have asked those of us on the DMNHUP coordinating committee questions. Below are the anwers to the two most frequently asked questions. These answers were verified as correct by Ernesto Aguilar, the assessment engineer for the project. If you have additional questions concerning your preliminary assessment, please send them to dmundergrounding@gmail.com and we will pass them along to Ernesto. |
| 1. Several people have asked why we are being charged with a view benefit when we don't have an ocean view. |
| In Del Mar when people say views we think of ocean views. The formula developed by the assessment engineer and approved by the Council includes the improved view that comes from no longer looking at poles and wires currently adjacent to one's property. |
| If you were to have an ocean view obstructed by a wire or pole you would have received an aesthetic view rating of 2 and if you had a partial view a rating of 1.5. Either one of these ratings would have meant a substantial increase in Part B of your draft assessment. A view rating of 1 results in a straightforward calculation based on the number of wire feet that is adjacent to, on, or surrounding your lot. |

2. Others are asking why I am being charged when the wires or poles are across the street from my house.
| The assumption is that the homeowners on both sides of the street benefit from the removal of the poles and wires. Consequently, the view benefit is based on not only the number of feet of wire on your side of the street but across the street as well. |

| Residents with questions or concerns regarding their preliminary assessments are invited to come to the City Hall Annex on Tuesday, January 19th, 3-5 pm and 6-8 pm, to consult individually with the assessment engineer, bond counsel, and/or financial advisors. |

January 14, 2010: Preliminary assessments.
| All of the major cost items for the project have been determined, and preliminary assessments calculated. There may be some adjustments as estimates are refined or altered by the Council, but it is expected that these will be minor. |

| Dear Homeowner: |
| Please note that in the draft assessment letter mailed Jan 13, the figure entered after "estimated cost per year if pay by 30-year bond" is misleading, as interest costs were not included in the calculation. We will not know the interest rate on the bond until it is actually secured and the number of people who elect bond financing is known. However, the City provided an estimate of the bond rate of 6.8%. The actual rate will be determined by conditions at the time of sale. It may be higher or lower than 6.8%. If one were to pay by bond at this interest rate, the yearly payment would be approximately 2.4 times the amount stated in our letter as the estimated cost per year. Of course, there will be no finance charges if you pay up front or if you choose to finance the amount on your own. |

| Undergrounding is back on track! |
| In cooperation with the City, we have worked with SDG&E to obtain a reduction in cost of nearly 30% from their initial bid for the cabling portion of the undergrounding project. While we had received very competitive bids from outside contractors for the trenching portion of the project, the initial bids from SDG&E for cabling were significantly higher than we had expected. |
| Through a combination of reanalysis on their part, and the City seeking competitive bids on portions of the project, these costs have been brought down to be in-line with our expectations. In addition, the City staff and the coordinating committee reviewed all aspects of the project to ensure that all details are tightly documented and properly budgeted. |
| Consequently, we are ready to resume the process, and have developed a tentative schedule as follows: |
| The coordinating committee is scheduled to mail out the proposed assessment amounts to homeowners around January 14th. Ernesto Aguilar of PBS&J, the independent professional services firm hired by the City to serve as the assessment engineer, will hold a meeting with property owners on January 19th to answer questions, and discuss concerns of individual homeowners. The City Council will then hold a public hearing on January 25th to hear issues and concerns of homeowners. The City Council could elect to approve the assessment report at that meeting, or may schedule a second public hearing on February 8th to consider approving the final report. If the City Council approves the final report the ballots will be mailed the week of February 9th. Home owners will then have 45 days to return their ballots. On April 5th the City will hold another public hearing at which time the ballots will be counted and a decision made on whether or not to commence with the undergrounding project. If the vote passes and the City approves the project, construction will begin in June, 2010. |

| October 26, 2009: Project delayed. |
| Dear Neighbors: |
| The estimate from SDG&E for the cabling portion of the project is much higher than was expected. Compared to the Ocean View/Pines project (the last Del Mar district undergrounded), it is multiple times higher per lot. Consequently, the coordinating committee has hired a consultant to evaluate their estimate for mistakes, unsupportable assumptions or hidden costs. They have the right to do the cabling work at their costs, but it is our understanding that they also can allow us to bid the cabling portion out to independent contractors. We believe it is in their interest and ours to allow us to do this. If they do, we believe we will be able to save substantial amounts of money on the project. |
| The bad news is that this will likely delay the project by 3 to 6 months. So for now the task of getting you your draft assessments is on hold until we can work through this difficulty. |

| October 21, 2009: Oct 27th meeting canceled. Due to a possible difficulty with the San Diego Gas and Electric bid, PBS&J will not be able to determine the draft assessments in time for
an October 27th meeting. We will mail you your draft assessments as soon as the City receives them and before the rescheduled draft assessment meeting. |
October 14, 2009: Oct 21st meeting postponed. Because of a problem with the bid from San Diego Gas & Electric Company, the engineering company, PBS&J, will not be able to complete the draft assessments in time for an October 21st meeting. Consequently, the draft assessment meeting scheduled for the 21st has been postponed and the presentation of the draft report to the City Council has been moved from October 26th to November 2nd.
Tentatively, the draft assessment meeting has been scheduled for Tuesday October the 27th at 6:00 p.m. at the City Annex. We will let you know as soon as the date is confirmed. We will be working with the city to ensure that all homeowners get their draft assessment before this meeting so you will
have time to identify concerns and issues that you want to discuss
with the city engineer regarding your assessment. In addition, all draft assessments for each parcel in the district will be posted on our website and on the bulletin board at the city as soon as they become available. |
September 2009: Schedule delays. Our latest information is that the presentation planned for September 12th will happen some time in October. Subsequent meeting dates identified below thus also will be rescheduled. As soon as we learn new dates we will post them here.
Please note that these delays will not shorten the amount of time you have to decide on how you want to vote. The law requires voting to take place 45 days after the ballots with the assessment information are mailed to the homeowners. |

August 27, 2009: Aesthetic View Ratings. PBS&J has produced maps for our district that show the preliminary ratings given to each property for the "aesthetic view" component of the benefits assessment. As described in Mr. Aguilar's presentation August 4th, the benefits assessment has two parts: (A) the district-wide benefits of improved reliability, safety, and community appearance; and (B) the view benefit to properties that currently have frontage with overhead wires. Part B assessments are based on the length of frontage from which wires would be removed, weighted for whether those wires are in a direct ocean view (2.0), indirect ocean view (1.5) or non-ocean view (1.0). Most parcels in our district that would have a Part B assessment were rated 1.0, which is color-coded in green on the maps. Properties that do not currently have frontage with overhead wires would not have a Part B assessment, would be assessed only their share of the Part A benefits. This information was mailed to district homeowners on August 27th. |
August 13, 2009: Construction Bids. The City has posted bid schedules for the construction work to underground the electric, phone and cable utilities in the North Hills and Sunset districts. We anticipate bids will be in by the second week of September and that we should have pretty solid numbers by mid October. |
August 6, 2009: Assessment Allocation Method. On August 4th and 5th Ernesto Aguillar from PBS&J engineering firm presented the methodology used to determine assessments for the lots in the Del Mar North Hills Undergrounding District at the Del Mar annex. Sixty plus members of the district attended the presentations .

Mr. Ernesto Aguilar, assessment engineer from the firm PBS&J, will explain the formula for the Del Mar North Hills assessment district, and answer any questions you might have regarding the formula, on Tuesday August 4th and then again on Wednesday August 5th. Both meetings will begin at 5:30 p.m. They will be held at the Del Mar Annex at 235 11th Street. The purpose of these meetings is to ensure that everyone understands the formula and has the opportunity to ask questions about it before it is used to calculate the assessments. The meeting is being held on two nights to increase the probability that everyone will have a chance to attend. Warren Diven, the city's bond counsel, will also be available to answer questions about the bonding process. |

June 1, 1009: Staking Above-Ground Structures. In a letter announcing the staking to show locations of proposed above-ground structures, the City included the dimensions of proposed boxes ("pedestals") as well as lists of all the proposed locations in both Sunset and North Hills districts.

April 20, 2009: Decisions made at the City Council Meeting.
The Del Mar City Council voted unanimously for the North Hills Undergrounding District to proceed with obtaining bids for the project as one district rather than three separate districts. However, the construction will proceed with each Area being considered as a separate stage. This approach will allow one area to be completed while work is progressing in other areas. Construction will start at the north end of the project and proceed to the south end.
The Council also agreed to erect story poles in June to mark the location and size of the transformers in both the North Hills district and the Sunset district. (The transformer locations for the DMNHUP area are listed below.) The story poles will help the Council and the community to decide whether to include the cost of erecting screening walls for the transformers in the bond.

February 26, 2009: Project schedule revised.
Homeowners are scheduled to receive the amount of their assessment on September 12th, 2009. Several public hearings will be held once the assessment notices are mailed. Then the ballot is scheduled to be mailed October 12, 2009. After the ballots have been returned via mail and counted a public hearing will be scheduled. It is expected that this public meeting will be held in the first weeks of December of 2009. At this time the City Council will review the outcome of the balloting and decide whether to go forward with the project. |
November 3, 2008: Project schedule extended.
Jennifer Chen of PBS&J sent an e-mail saying the schedule had been extended seven weeks due to the fact that AT&T did not complete their part of the design on schedule. According to the revised schedule, the assessment design phase will be completed by March 2, 2009 (including notification of homeowners), the mail-in ballot is now scheduled for June 18th 2009. |
June 21, 2008: Above-ground structures.
Three meetings were held at the Del Mar Annex; one for each of the DMNHUP areas. Maricella Leon from SDG&E answered questions and displayed maps showing the lots planned for above ground structures: transformers and fuse boxes. Ernest Aguilar from PBS&J answered general questions about the process. Transformers are 3’x3’x3’; the fuse cabinets are 3.5’ wide 4’ tall and 4’ deep. All transformers and fuse cabinets are in the public right of way. |
April 25, 2008: San Diego Gas and Electric's portion of the design is nearing completion. The cable and telephone companies must now complete their designs. We plan to have a meeting of each of the three North Hills district on Saturday, June 21st, 2008. At this meeting, the location of the transformers and other above ground structures will be identified. Representatives of both San Diego Gas and Electric and PBS&J, the City's engineering firm, will be available to answer other questions related to the design. The homeowner costs are scheduled to be available in January of 2009 after the design of the communication companies portion of the project are completed. |

September 20, 2007: The Del Mar City Council voted to add 23 properties to Area 2 of the North Hills Underground Project. These properties are located along Van Dyke Avenue, Luneta and Carolina. The property owners presented petitions favoring the project from 20 of the 23 affected property owners. The Council required the group to pay 50% of the up front costs or $5,500. They also indicated that no more properties would be added to the Del Mar North Hills Underground District. |
July 1, 2007: PBS&J personnel have begun the assessment process. They are starting the south end of the proposed district and working their way north. These site visits will be made primarily by Ernesto Aguillar and Dean Gipson of PBS&J (see photos below). The visits begin in Area 3, then Area 2 and then Area 1 (south to north) and should be be completed by August 3rd, 2007. |
June 6, 2007: PBS&J to visit sites in July.
Joe Hoefgen is leaving the city to take a job as city manager in Palos Verdes Estates. Ernesto Aguilar of PBS&J engineering firm will be managing the Del Mar Undergrounding Project in Joe's place. At a meeting with the DMNHUP area leaders, Ernesto outlined his plans for the project. PBS&J engineering firm will begin the assessment process this July by visiting the sites in the district.
You will likely see them walking your neighborhood during July and in some cases they will enter your property to check views, connections and make other observations necessary for determining the amount of each property owner's assessment. |
March 19, 2007: The Del Mar City Council approved the formation of an assessment district. The exact boundaries have not been determined but will follow the approximate boundaries in the map presented. Also, it has not been determined whether the district will be treated as one large district or two or three smaller districts. These determinations will depend on such things as whether a larger district will yield economies of scale.

December 15, 2006: Members of the Del Mar North Hills steering committee met and discussed various options for moving forward in light of our recent meeting with Council persons Drucker and Finnel (described below). One of the options discussed was holding a meeting with the people in the middle and south sections to decide what they wanted to do since the north section is the only area that meets the money and petition standard set by the City Council. We wrote to Joe Hoefgen asking if we could assume that the mid and south section would qualify with 17.5 % of the projected costs. The steering committee will be meeting the first part of January to decide how to proceed. |
December 4, 2006: Members of the Del Mar North Hills steering committee met with council persons David Drucker and Jerry Finnel, Assistant City Manager Joe Hoefgen and City Manager, Lauraine Brekke-Esparzato to discuss ways of moving the North Hills Undergrounding Project forward.
Council persons Finnell and Drucker expressed concern about the level of commitment to the project in the mid and southern sections of the area. Their concern is the cost to the city if the project is voted on and defeated. They want to ensure, as much as possible, that the residents do in fact want the poles undergrounded and are willing to pay the assessment and other fees that would be required and thus reduce the risk to the city.
In light of their concerns, they suggested that the DMNHUP Steering Committee consider two alternatives: (1) dividing the proposed area into three sections and doing just the north section where the support seems to be the strongest, (2) collecting more money and more signatures from the middle and southern sections of the area. They believe either of these alternatives would reduce the risk to the city.
We will post a map soon indicating the boundaries of the three proposed sections.

November 13, 2006: The Del Mar City Council heard the steering committee's request to form an assessment district and ruled that we would need to raise an additional $14,000 before they would consider it. The steering committee has been working under the guidelines that says the amount that needs to be raised is $16,000. We raised that amount and gave it to the city along with 190 plus petitions (over 75% per cent of the households in the proposed district), but the council felt it was important to raise another $14,000. This would mean that the proposed North Hills district would pay the same percentage of upfront costs that the Ocean Pines district paid. When the district is formed, all of the upfront money will be repaid to the district and the people in the district who supported the project by making a deposit. |

October 2006: Our checks and petitions were submitted to city staff, but the City Council presentation was delayed because two of the city council members, Carl and Henry, must recuse themselves because they live in the proposed undergrounding district, and Jerry Finnell would be absent because of sickness, so we would not have a legal quorum to hear our proposal to form a district. |
The steering committee has been meeting once a month since February of 2006 to get the project started. Because we were receiving so many requests to be part of the project, we established the following criteria for inclusion: |
a. There must be a volunteer willing to do all of the work necessary to see the project through to completion.
b. At least 75% of the homeowners in a proposed area must indicate an interest in undergrounding the poles by signing a petition.
c. Any addition to existing areas should be a logical extension from an engineering perspective.
d. The areas should be contiguous. |

Our goal in establishing the criteria was to get a project large enough to obtain the economies of scale but at the same time limit the size to one that we felt we could manage and would have a good chance of being successful. Based on the results so far, it appears all areas will easily meet the 75% criteria. |
